Ithaca shooting suspect in court

ITHACA, N.Y. -- The man accused of a shooting in an Ithaca apartment complex appeared in court Wednesday. Longtime Ithaca resident Corbin Whyte, 26, has been charged with second degree murder after deputies say he shot another man in the chest.

Deputies were called to the Maple Hill Apartments in the Town of Ithaca around 2 a.m. Tuesday. When they arrived, they found 47-year-old Paul Garcia shot to death in the parking lot.

Corbin was arrested after at least one witness placed him at the scene.

The case is scheduled go before the grand jury Thursday, a move Corbin's attorney questioned, saying he hasn't yet been shown all the evidence.

"Obviously the police made a very instantaneous arrest," said defense attorney Joe Joch. "The defendant was not arrested anywhere near the crime scene. So it raises the issue of what is the reason the people, meaning the prosecutor, and the police think that my client did it."

Corbin is being held without bail in the Tompkins County Jail. The prosecution declined to comment.
