MARLBOROUGH, N.Y. -- Police have arrested the man they say took his child from daycare after a fight with the child's mother.
Marlborough Police say Frederick McCluskey, 27, took his son, Frederick, 4, from Alphabet Tree Daycare in Marlborough. It happened around 9 a.m. Friday, and prompted a statewide AMBER Alert.
McCluskey was actually found in the Town of Gardiner with the child.
Police say they spotted McCluskey on Route 9-W, but didn't pull him over because he was driving dangerously.
"You have to understand that sometimes when we attempt to stop a vehicle, if it gets too dangerous, we pull back. We're not going to continue with the attempt to stop. We will try and follow at a safe distance with traffic and all that. Sometimes, we have to fall way back,” said Joseph Lofaro, Marlborough Police Department.
McCluskey is charged with reckless endangerment, endangering the welfare of a child and reckless driving. Other charges are pending against McCluskey in the Town of Newburgh.
His son, meanwhile, was not injured. He's been returned to his family.
