VIENNA, N.Y. -- State Police are investigating a motorcycle accident in Vienna that left one man in critical condition. It happened late Tuesday night when a car turned in front of a motorcycle at the intersection of Powell Road and Route 13.

Police say Tracy Mackey, 55, the driver of the motorcycle, was wearing a helmet, but was still flown to Upstate University Hospital with broken wrists and feet and internal trauma.

The driver of the car, Robert Berninger, 74, had minor injuries.

Police say Berninger will probably be charged with a failure to yield ticket, but nothing further.
