Lawsuit against ECSD heads to trial

CHEMUNG COUNTY, N.Y. -- A lawsuit against the Elmira City School District and two board members heads to trial today. The legal issues started in 2006, at the time of former assistant superintendent Bob Gosden's retirement.

Two audits, one by the state and another by the district, found that he may have been overpaid for unused vacation time. Gosden settled with the district and repaid some of the money, but the settlement also included a confidentiality provision for all parties involved.

Gosden claims that shortly thereafter, two members of the school board made libelous statements about him to a local newspaper and at a board meeting. He's now suing, claiming that those comments cost him and his consulting firm numerous jobs.

The lawsuit is for $4 million. The trial is currently underway, being heard in State Supreme Court in Elmira.
