Tomaszewski refuses jury trial

ONONDAGA COUNTY, N.Y. -- The driver responsible for the Megabus crash on Onondaga Lake Parkway has refused his right to a jury trial.

John Tomaszewski was driving the double-decker bus from Philadelphia to Syracuse in 2010, when the bus hit the low bridge on the parkway, killing four people and injuring several others.

Tomaszewski faces four counts of criminally negligent homicide.

At his appearance Thursday, he opted for a bench trial.

Both sides say with or without a jury, they are ready for the trial to begin.

"I think there's a lot of diametric opinions. I think some people think the state should have done more, that CSX railways should have done more. A lot more could have been done, but there are those other people that say hey, if you miss a sign, you need to go to jail," said Eric Jeschke, Tomaszewski’s lawyer.

"We feel we have a good case. The grand jury considered all the evidence and voted an indictment and we'll see what the judge thinks about it," said Senior Assistant District Attorney Chris Bednarski.

The trial is set to being later this month.
