Witnesses get emotional in Oxley trial

By: Cara Thomas

It was an emotional day in the Wayne Oxley trial. Seven witnesses took the stand for the defense Wednesday, but as our Cara Thomas tells us, many of them didn’t know Oxley at all. The defense is calling witnesses to the stand who point to someone else committing the murder.

ST. LAWRENCE COUNTY, N.Y. -- A very nervous Michelle Disotell took the stand in the Wayne Oxley re-trial, with new information a jury had yet to hear. On Tuesday, Disotell and the defense had requested that her name remain anonymous, but on Wednesday, the judge denied that request.

Disotell testified being at Bernard Trickey's home hours before he was murdered. She said Robert Webb, also referred to as “Chase,” arrived at the house soon after. Disotell says Webb began arguing with Trickey and told everyone who was there to leave.

It was only a week or two later that Disotell says Webb admitted to killing Trickey. She says Webb threatened her a few weeks later and said if she opened her mouth, he would kill her children and then kill her.

The witness also testified that a few days before the murder, Webb had told her he was going to kill Trickey. Disotell's mental health history was brought up by the prosecution, as well as her own criminal charges and a pattern of lying. After seeing Disotell's health records, the judge told the court that Disotell had been in an inpatient program for months up until the day of the murder, making her conversation with Webb before the murder impossible. Further cross-examination of Disotell will continue on Thursday.

Multiple other witnesses testified regarding their interactions with Robert Webb, including threats and altercations. One witness said Webb had told her he would make her disappear just like Trickey.

Throughout the trial the defense has brought up the possibility of a gun being used during the murder. Wednesday, one witness testified that she found bullet casings in Trickey's home while she was cleaning up the crime scene. The defense also hopes to bring in a ballistics expert to take the stand.
