It was shocking news for the City of Ogdensburg the day Bernard Trickey Jr. was found beaten to death with a baseball bat in his New York Avenue home. Five years later, the case is still in court. Our Rachael Paradis tells us where things stand, six weeks into the second murder trial of Wayne Oxley.

ST. LAWRENCE COUNTY, N.Y. -- After eight days of jury selection and nearly four weeks of testimony from the prosecution, Wayne Oxley's fate is now in the hands of his defense.

Tuesday, they continued their case by calling to the stand Jen Ritchie, a woman who says another man named Robert Webb admitted to her that he was actually responsible for the 2005 death of Bernard Trickey Jr.

Ritchie she said, "(Webb) said I'll make you disappear like I did him. You know what I mean. On New York Ave."

However, Ritchie never reported the incident to police.

Another witness who took the stand offered an alibi for that August night. Oxley's co-worker, Travis Howe, says he and Oxley spent the night together drinking wine and hanging out at Oxley's home. However, when he spoke to police in 2005, he gave a different story.

"I told police I left (Oxley's) house at 11 p.m." Howe said.

Police say Trickey was murdered early the next morning.

Oxley was convicted of the murder in 2006, which was overturned in 2009 when it was found a key witness shouldn't have been allowed to testify.

Judge Jerome Richards expects the retrial to last about three months. The defense is almost two weeks in.
