Police to hand over Fine files to DA’s office Tuesday

SYRACUSE, N.Y. -- The police investigation into Bernie Fine has led to a battle between the city and the District Attorney's office.

Last week, District Attorney William Fitzpatrick demanded the city turn over its files on the case against Fine. The city refused and Fitzpatrick served a subpoena on the department.

Now we have learned the Syracuse Police will hand over the files to the DA's office Tuesday morning, avoiding a Supreme Court battle. The department says the decision was made after the investigation entered a "new phase" involving the U.S. Attorney's Office and the U.S. Secret Service. Both of those agencies were involved in the raid on Fine's house Friday.
